These terms and conditions (“Terms”) govern your use of our website and services (“Services”). By using our Services, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old to use our Services. If you are under 18, you may only use our Services under the supervision of a parent or legal guardian.

2. User Account

You may need to create an account to use certain features of our Services. You are responsible for maintaining the confidentiality of your account information and password, and for all activity that occurs under your account.

3. User Submissions

Our website may allow you to submit reviews, comments, and other content (“Submissions”). You retain all ownership rights to your Submissions, but you grant Foodbasket a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and translate your Submissions.

4. Website Content and Pricing

We strive to provide accurate information on our website, but errors may occur. We reserve the right to correct any errors and to refuse or cancel orders at our sole discretion. Prices may vary depending on item versions and actual weights. You will be billed for the actual weight of weighed items.

5. Order Acceptance and Cancellation

We reserve the right to accept or cancel orders at our sole discretion. We will notify you if your order is canceled.

8. Use of Materials

The content of our website is protected by copyright and other intellectual property laws. You may only use the content for personal, non-commercial purposes.

9. Territorial Use

Our Services are intended for use in Nigeria. Accessing our Services from territories where our content is illegal is prohibited.

10. Applicable Law

These Terms will be governed by the laws of Nigeria.

11. Limitation of Liability

We are not liable for any damages arising from your use of our Services.

12. Indemnity

You agree to indemnify and hold harmless Foodbasket from any claims or damages arising from your use of our Services.

13. Termination

We may terminate your access to our Services at any time for any reason.

14. Delivery Windows

We offer delivery windows, but they are an estimate. We guarantee delivery within 4 days of your chosen delivery window.

15. Communication During Order Processing

We may contact you to discuss item availability and suggest replacements. You must respond within 15 minutes to confirm replacements.

16. Access to Your Delivery Location

If access to your location is limited, you may need to meet the driver at a different location. Failure to notify us of access issues may result in a delayed or canceled delivery.

17. Meeting Our Delivery Driver

Drivers will wait a maximum of 5 minutes for you to receive your order. If you are unreachable, your order may be rescheduled at an additional cost. We are not liable for damaged perishable items due to wait times.

18. Cancellations

Orders cannot be canceled once payment is received because we purchase from farmers upon receiving your order, and the farmers have a strict no-return policy.

19. Refunds

If an item is unavailable, we will credit your Foodbasket eWallet (no refunds to bank accounts). Refunds may also be processed to your bank account in specific cases (e.g., undeliverable address, payment issues), minus relevant charges.

20. Treatment of Employees

We expect our customers to treat our employees with courtesy and respect. We will not tolerate any abuse towards our employees. Abusing an employee may result in the refusal to fulfill your order or a report to law enforcement.

21. Changes to These Terms

We may change these Terms at any time. We will post any changes on our website.
